BUDGET HEARING ON THE PROPOSED 2019 BUDGET

The City of Thornton, Colorado, will hold a public hearing on Tuesday, November 13, 2018 at or about 7:00 p.m., or as soon thereafter as possible, in the City Council Chambers at City Hall, 9500 Civic Center Drive, Thornton, Colorado 80229, for the purpose of hearing oral and taking written comments from the public concerning the Pay Plan for the fiscal year of 2019.

 

All interested citizens, groups, and organizations are encouraged to attend and submit comments.

 

A copy of the 2019 proposed Budget is available for inspection by all interested parties in the City Clerk's Office.

NOTICE AS TO THE PROPOSED CHANGES TO THE SALARY AND FRINGE BENEFIT PLAN FOR THE CAREER SERVICE EMPLOYEES OF THE CITY OF THORNTON.  Notice is hereby given that proposed changes to the salary and benefit plan for Career Service employees have been submitted to the Thornton City Council for the ensuing year of 2019.  That a copy of such proposed changes to the salary and benefit plan have been filed in the Office of the City Clerk, where same is open for public inspection.  That such proposed changes to the plan will be considered at a regular meeting of the City Council, to be held at the Council Chambers at City Hall, 9500 Civic Center Drive, on November 13, 2018, at 7:00 p.m., or as soon thereafter as possible.  At said hearing, any employees or agents or representatives of employees, including unions, may appear, in addition to any other interested parties, to file their objections to, or approval of, said changes to the salary and benefit plan.

PETITION FOR THE ORGANIZATION OF THE RII-DII BUSINESS IMPROVEMENT DISTRICT IN THE CITY OF THORNTON, COLORADO, AND CONSIDERATION OF AN ORDINANCE ORGANIZING THE RII-DII BUSINESS IMPROVEMENT DISTRICT, APPOINTING THE INITIAL BOARD OF DIRECTORS, APPROVING THE 2018 OPERATING PLAN AND BUDGET, AND DESIGNATING THE AREA AS A LOCATION FOR NEW BUSINESS OR COMMERCIAL DEVELOPMENT

 

PUBLIC NOTICE IS HEREBY GIVEN that there was filed in the office of the City Clerk of the City of Thornton, Colorado, a Petition for the Organization of the RII-DII Business Improvement District ("Proposed District") in accordance with the provisions of the Business Improvement District Act, Part 12 of Article 25 of Title 31, C.R.S.  Said Petition is pending the hearing on the sufficiency of said Petition and action on an ordinance to organize the Proposed District by the City Council as the governing body of the City of Thornton, Colorado (the "City").

 

Said Petition states, among other things: 

 

(a)        A general description of the boundaries and service area of the Proposed District, attached hereto as Exhibit A and incorporated herein by reference;

 

(b)        The Proposed District shall be empowered to provide all or part of the services and improvements allowed under Colorado law for business improvement districts, including "Improvements" as that term is defined in Section 31-25-1203(5), C.R.S., services as described in Section 31-25-1212(1)(f), C.R.S., and other powers granted to such districts under Section 31-25-1212, C.R.S., to the extent set forth in its Operating Plan; and

 

(c)        That the initial five (5) members of the Board of Directors of the Proposed District shall be appointed by the City, as provided in Section 31-25-1209(1)(b), C.R.S.

 

The petition is on file at the office of the City Clerk of the City of Thornton and is available for public inspection. 

 

NOTICE IS FURTHER GIVEN that by resolution of the City Council, a public hearing on said Petition shall be held at 7:00 p.m., on Tuesday, the 11th day of September, 2018, at Thornton City Hall, 9500 Civic Center Drive, Thornton, CO 80229, at which time and place any interested party may appear and be heard on the sufficiency of the Petition.

These notices are intended to meet two separate but related procedural requirements for activities to be undertaken by the City of Thornton, for the Request for Release of Funds (RROF) and the Finding of No Significant Impact (FONSI).

REQUEST FOR THE RELEASE OF FUNDS

The week of November 26, 2018 the City of Thornton will submit a request to the U.S. Department of Housing and Urban Development (HUD), Region VIII, Denver, Colorado, as applicable on behalf of City of Thornton for the release of Community Development Block (CDBG) Program funds under 24 C.F.R. 570, Title I of the Housing and Community Development of the Act of 1974, as amended, to acquire property in a CDBG-eligible area for a future park and pay for the design of the park. This Public Facilities and Infrastructure Improvement project will be funded with $525,000 of 2018 CDBG funds.

FINDING OF NO SIGNIFICANT IMPACT

The City of Thornton has determined that the projects will have no significant impact on the human environment.  An Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) for the CDBG Program 24 C.F.R. Part 58, therefore, is not required. However, the City will complete Environmental Review Records (ERR) to carry out its Environmental Responsibility and to meet NEPA (National Environmental Policy Act) Procedures.  Additional program, projects and activities determination and/or information are contained in the ERR and the Environmental Assessment Review Guidelines which support the FONSI and are on file at the City of Thornton.  These can be reviewed by writing a request and/or contacting Neighborhood Services, at 9500 Civic Center Drive, Thornton, Colorado, 80229 or 303-538-7600 or cdbg@cityofthornton.net.  These environmental records are available for review, copy and/or examination during normal business hours 8 A.M. to 5 P.M., Monday through Friday.

PUBLIC COMMENTS FOR FONSI OR RROF

Any individual, group, or agency may submit written comments to Neighborhood Services staff at the City of Thornton as designated above.  All comments received within 15 days of this notice, but not later than November 26, 2018 by 5:00 P.M., will be considered by the City of Thornton prior to authorizing submission of a RROF or FONSI to the U.S. Department of HUD. 

RELEASE OF FUNDS

The City of Thornton certifies to HUD that Mr. Kevin Woods in his capacity as City Manager, consents to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD approval of the RROF and FONSI certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Thornton to use allocated CDBG Program funds.

OBJECTIONS TO THE RELEASE OF FUNDS

HUD will accept objections to its release of funds and the City of Thornton's RROF and FONSI certifications for a period of fifteen days following the anticipated submission date or its actual receipt of the request, whichever is later,  only if they are made on one of the following bases:  (a) the certification was not executed by the Certifying Officer of the City of Thornton; (b) the City of Thornton has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before the approval of a release of funds by HUD; or (d) another Federal agency, acting pursuant to 40 CFR part 1504, has submitted a written finding that the program, project and/or activity is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures of 24 CFR Part 58 and shall be addressed to the U.S. Department of Housing and Urban Development, Region VIII Office, Attention: Field Environmental Officer, 25th Floor, 8ADE, 1670 Broadway Street, Colorado 80202-4801.  Potential objectors should contact HUD to verify the actual last day of the objection period.

NOTICE IS HEREBY FURTHER GIVEN that the City Council of the City of Thornton, Adams County, Colorado, will hold a public hearing at 7:00 pm, or as soon as possible thereafter, on Tuesday, December 18, 2018, in the Council Chambers at the Thornton City Hall, 9500 Civic Center Drive, Thornton, Colorado, to consider approval of the Second Amended and Restated Service Plan.

The District consists of approximately 114 acres of commercial and residential land and is located entirely within the City of Thornton, and is generally located south of 164th Avenue, east of I-25, west of Washington Street and north of 160th Avenue.

The District was previously organized as a metropolitan district to finance the construction of certain public improvements for Larkridge Filing No. 2 Subdivision and has the authority to impose a mill levy for repayment of debt and for limited administrative, operation and maintenance purposes. The purpose of the Second Amended and Restated Service Plan is to increase the total debt issuance limitation commensurate with increased public improvements costs, and provide clarification on the debt mill levy imposition term.

For debt service, the maximum mill levy that may be imposed upon taxable property within the District's boundaries shall not exceed fifty (50) mills; however, this maximum shall not apply when the total amount of debt is equal to or less than fifty percent (50%) of the District's assessed valuation. There is no maximum mill levy limit that may be imposed by the District upon taxable property within the District for operations and maintenance. If the method of calculating assessed valuation is changed by law, the maximum mill levy may be increased or decreased to reflect such changes.

NOTICE IS FURTHER GIVEN that any protests or objections to the District's proposed Second Amended and Restated Service Plan must be submitted in writing to the City Council of the City of Thornton at or prior to the hearing, or any continuance or postponement thereof, in order to be considered.  All protests and objections to the Second Amended and Restated Service Plan, as proposed, shall be deemed waived unless presented in writing at the time and manner specified above.
