PETITION FOR THE ORGANIZATION OF THE RII-DII BUSINESS IMPROVEMENT DISTRICT IN THE CITY OF THORNTON, COLORADO, AND CONSIDERATION OF AN ORDINANCE ORGANIZING THE RII-DII BUSINESS IMPROVEMENT DISTRICT, APPOINTING THE INITIAL BOARD OF DIRECTORS, APPROVING THE 2018 OPERATING PLAN AND BUDGET, AND DESIGNATING THE AREA AS A LOCATION FOR NEW BUSINESS OR COMMERCIAL DEVELOPMENT

 

PUBLIC NOTICE IS HEREBY GIVEN that there was filed in the office of the City Clerk of the City of Thornton, Colorado, a Petition for the Organization of the RII-DII Business Improvement District ("Proposed District") in accordance with the provisions of the Business Improvement District Act, Part 12 of Article 25 of Title 31, C.R.S.  Said Petition is pending the hearing on the sufficiency of said Petition and action on an ordinance to organize the Proposed District by the City Council as the governing body of the City of Thornton, Colorado (the "City").

 

Said Petition states, among other things: 

 

(a)        A general description of the boundaries and service area of the Proposed District, attached hereto as Exhibit A and incorporated herein by reference;

 

(b)        The Proposed District shall be empowered to provide all or part of the services and improvements allowed under Colorado law for business improvement districts, including "Improvements" as that term is defined in Section 31-25-1203(5), C.R.S., services as described in Section 31-25-1212(1)(f), C.R.S., and other powers granted to such districts under Section 31-25-1212, C.R.S., to the extent set forth in its Operating Plan; and

 

(c)        That the initial five (5) members of the Board of Directors of the Proposed District shall be appointed by the City, as provided in Section 31-25-1209(1)(b), C.R.S.

 

The petition is on file at the office of the City Clerk of the City of Thornton and is available for public inspection. 

 

NOTICE IS FURTHER GIVEN that by resolution of the City Council, a public hearing on said Petition shall be held at 7:00 p.m., on Tuesday, the 11th day of September, 2018, at Thornton City Hall, 9500 Civic Center Drive, Thornton, CO 80229, at which time and place any interested party may appear and be heard on the sufficiency of the Petition.

The City Council of the City of Thornton (City) will hold a public comment period and public hearing related to the 2017 Consolidated Annual Performance and Evaluation Report (CAPER) prior to submission to the U.S. Department of Housing and Urban Development (HUD).  

The CAPER provides an assessment of the City of Thornton's progress in carrying out the 2015-2019 Consolidated Plan and the 2017 Annual Action Plan for Community Development Block Grant (CDBG)-funded programs and services that target low and moderate income residents.  The document includes information on the 2017 accomplishments, how obstacles were addressed, how other resources were leveraged, what monitoring activities took place, the citizen participation process, and what actions were taken to affirmatively further fair housing.  The CAPER also describes what actions were taken in 2017 to meet housing, homeless, community development and non-homeless special needs. The 2017 program year ran from July 1, 2017 to June 30, 2018.   

Public Comment Period

The purpose of this notice is to mark the beginning of the 15-day public comment period, which will run from August 30 through September 14 at 5:00 p.m.  A draft copy of the CAPER can be viewed online at www.cityofthornton.net.  Also, residents can pick up a copy from Thornton's City Development Department at 9500 Civic Center Drive. Thornton residents may provide their thoughts on the CAPER during the public comment period by emailing cdbg@cityofthornton.net, or mailing letters to City of Thornton c/o CDBG, 9500 Civic Center Drive, Thornton, CO 80229.

The City Council of the City of Thornton (City) will hold a 30-day public comment period and public hearing for the amendments to the 2016 Annual Action Plan (AAP) and 2017 AAP, prior to submission to the U.S. Department of Housing and Urban Development (HUD). 

The amendments propose to add projects to be funded with the City of Thornton 2016 or 2017 CDBG funds. While the City originally funded multiple projects with 2016 CDBG funds and 2017 funds, some of these projects have not needed as much funds as anticipated. Therefore, the City would like to add one project to the 2016 AAP and three projects to the 2017 AAP to absorb the remaining funds. All projects eligible for funding meet national grant objectives, and benefit persons of low- and moderate- income.

Public Comment Period

The public comment period runs from Thursday, September 27, 2018 to Monday, October 29, 2018 at 8 a.m. Residents are welcome to provide comments on the substantial amendments and additional projects proposed to receive CDBG funding during this period. At said time and place, any interested persons may appear to be heard for or against the granting of this license.
